Terms and Conditions (T&C) of the poii App

§ 1 Scope

(1) These Terms and Conditions (hereinafter "T&C") apply to the use of the mobile application "poii" (hereinafter "App").

(2) By registering in the App, users (hereinafter "Users") bindingly agree to these T&C.

§ 2 Subject Matter of the Agreement

(1) poii enables users to save, organize, and share personal locations.

(2) The use of the App is generally free of charge. Future premium features will be clearly marked and require explicit consent.

§ 3 Registration and User Account

(1) Registration is required to use the App. Information provided during registration must be complete and truthful.

(2) Users agree not to use any usernames or content that is illegal, offensive, discriminatory, racist, extremist, sexist, or otherwise inappropriate.

(3) The provider reserves the right to modify, delete, or suspend usernames that violate these guidelines at any time without notice.

§ 4 User Obligations

(1) Users agree to:

• not distribute criminal content (e.g., hate speech, incitement to violence, pornography, sedition) in the App,

• not post xenophobic, far-right, or discriminatory statements or content,

• not violate third-party rights (e.g., copyright, trademark, personality rights),

• not use automated tools or bots,

• not to trade with usernames / handles,

• not place commercial advertising without explicit consent.

(2) In case of violation of these obligations, the provider may delete content, warn users, restrict functions, or permanently suspend the account.

§ 5 Content and Rights

(1) Users retain copyright of their content. However, by uploading, they grant the provider a simple, unlimited, non-exclusive right of use to display, store, and reproduce the content within the App. Furthermore, the provider is allowed to use any uploaded content from users for commercial use both in case of partnerships with external partners and for campaigns of the provider itself.

(2) The provider is not liable for content uploaded by users. There is no prior review by the provider.

§ 6 Availability and Liability

(1) The provider strives to ensure smooth operation of the App but does not guarantee availability, uninterrupted service, or freedom from errors.

(2) The provider is only liable in cases of intent or gross negligence. Liability for indirect damages is excluded.

§ 7 Termination and Deletion

(1) Users can delete their account at any time through the App.

(2) The provider may terminate a user account with immediate effect in case of repeated or serious violations of these T&C.

§ 8 Data Protection

(1) Information about the processing of personal data can be found in the Privacy Policy.

(2) Data is processed exclusively within the framework of GDPR requirements.

§ 9 Changes to the T&C

(1) The provider reserves the right to modify these T&C at any time. Users will be informed of significant changes in due time.

(2) If users do not object to the modified T&C within 14 days, they are considered accepted.

§ 10 Final Provisions

(1) The laws of the Federal Republic of Germany apply.

(2) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.

(3) The place of jurisdiction, where legally permissible, is the provider's registered office.
